7:36 am

court. nobody seemed to have five courts. now that they move into a different phase of trying to work out some kind of agreement that is when things could change. and all we can do is wait to see what the court does. >> can you pull the curtain back and tell us what happens between now and june? >> reporter: i think their next conference i believe it's tomorrow. their next conference they will take votes sort of tentative votes to decide where the cases go. now it could well be that nobody's got the votes to do anything and they basically behind the scenes try to offer up different ideas as to how to construct an opinion. how to get five votes. one thing we could have is have four votes for something. one justice who doesn't agree with those four but sort of agrees with the thrust of it and you wouldn't have a controlling opinion. a lot of different possibilities here and all we can do is sit outside the court and wait to see what they do. >> is there any chance we would
7:38 am
hear a decision before june or is it certain it would be june we'll hear the earliest. >> reporter: the only way we would hear something before june is if the court throws up its hands and decides not to rule. especially on the prop 8 measure. the defense of marriage act that would be held to the end. usually what the justices do they wait until that last week of june when they wrap up all their business and they save the biggest cases for last. i don't know if the gay marijuana case will be held for the last. i don't think they would get any ruling out of the court. until that last week in june. >> we'll probably just have to look forward to that. certainly we will remember a year ago in june waiting for the health care decision certainly high drama there. >> reporter: i expect to be back there this june. >> we'll look forward to you. thank you jamie. and you can find a look to jamie's washington insider blog
